Top Nepal ministers travelling with the Prime Minister told B&E that the Treaty was skewed in India’s favour.

What’s more, the results have already borne fruit; rarely do significant diplomatic gains accrue in such a short span of time. On the last day of his stay in Delhi before he left for Bangalore to explore possibilities of tie ups in the IT industry, India had already given in. Foreign Secretary Shiv Shankar Menon told reporters that India was ready to ‘update’ the 58-year-old bilateral Trade and Transit Treaty, which would have a bearing on all aspects of ties between the two countries. Top Nepal ministers travelling with the Prime Minister told B&E that the Treaty was skewed in India’s favour. “This is the Nepal of 2008 and not of 1950. The ground realities have changed a lot in these five decades,” Nepal’s Foreign Minister, Upendra Yadav, told B&E in a special interaction (see interview).

Now that India has agreed to ‘update’ the Treaty, did it mean it was prepared to accept any fundamental changes? Menon provided the clues, “Both sides should sit together to review, to reflect on today’s reality. By updating, I am not limiting our options.” India’s Foreign Secretary indicated that talks between the two Home Secretaries would also review the security situation. India has strongly conveyed to Nepal that it is becoming a safe haven for ISI activities and that steps would be needed to dismantle the infrastructure that the Pakistanis have set up there.

By any yardstick, Prachanda’s visit could be considered a success. The two sides reviewed in detail various water resources projects. Water Resources Minister, Saifuddin Soz, met his counterpart, Bishu Prasad Boudel to take stock of the Kosi floods in Bihar with yet another policy shift: the two sides agreed to ‘properly’ implement the 1954 Kosi agreement to prevent such situations. Prachanda, who made water resources management an important part of his agenda in India, was rewarded further. India and Nepal have agreed to the creation of a three-tier joint mechanism for water management joint river commission (JRC) at the level of ministers, a joint committee at the level of Secretaries for water resources and project level technical panels, eight of which would be formed soon.
